Missing persons report brings sex offender's Denny bail breach to light

A missing person report help to uncover an offender breaching his sexual offences prevention order.

Appearing at Falkirk Sheriff Court last Thursday, David Wallace, 20, had pleaded guilty to breaching his sexual offences prevention order, which had been put in place at Edinburgh Sheriff Court under the Sexual Offences Act 2003 on November 18 last year.

As part of the order Wallace must notify police if he moves or changes address for at least seven days.

The charge stated he failed to do this when he moved into a property in Brewster Place, Denny, from July 1 and July 11 this year.

"He is under current requirements to notify police of his address,” said the procurator fiscal depute. “If he was going to be staying somewhere for more than seven days.

"He was staying at an address in Denny and hadn’t told police about it.”

It was a report of a missing person – Wallace himself – which brought his breach to light.

"The accused was traced when he informed police he had been staying at the address in Denny and had not returned home since.”

Sheriff Craig Harris said: “You are on a community payback order and you are making progress with that. It was those who were monitoring the order who were concerned about your whereabouts.

"Someone who was assisting social work reported you missing.”

The court heard Wallace’s order ran until September 2027.

Sheriff Harris deferred sentence on Wallace, 37, 16 Buchanan Street, Edinburgh, until March 4, 2027.

"The court will revisit this in six month’s time,” he said.
