Denny mum-of-three over two times higher than legal drug drive limit

A mum of three young children thought she was okay to get behind the wheel of a car after she had been smoking cannabis.

Hannah Shearer, 35, appeared at Falkirk Sheriff Court last Thursday having admitted driving while unfit through drugs on Glasgow Road, Denny on January 15. gave a reading of 5.2 microgrammes of delta-9-tetrahydrocannabinol per litre of blood, when the legal limit is 2 microgrammes.

"It was noon and traffic conditions were light and the weather was dry,” said the procurator fiscal depute. “It was a two way carriageway with one lane going in each direction and the accused was heading northbound.

"Police were on patrol when they saw the car and stopped it for a vehicle check. The accused opened the driver side window and police detected a strong smell of cannabis from within.”

Lynn Swan, defence solicitor, said: “There was nothing in relation to the manner of her driving – this was just a vehicle check carried out by the police. She co-operated fully with everything that was asked of her.

"She has been smoking cannabis on occasion and accepts she has done so on this occasion. She thought it would be okay to drive and that is a mistake she has made.”

The court heard not being able to drive would be a punishment on Shearer, 94 Overton Crescent, Denny, and her three young children.

Sheriff Maryam Labaki placed her on a community payback order with the condition she completes 133 hours of unpaid work within 12 months. She also banned her from driving for 12 months.
