Westquarter offender stopped by police driving his 92-year-old gran's car

A man who admits to drinking too much refused to give a breath specimen and crooned a tune for police instead.

Appearing at Falkirk Sheriff Court on Thursday, Russell Dunn (44) admitted to failing to provide specimens of breath at Falkirk Police Station on November 24 last year.

Procurator fiscal depute Rachel Wallace said: “The accused was taken to Falkirk Police Station in relation to an earlier incident. While waiting to be processed and while in the rear of the police vehicle the accused continually kicked and used his shoulder to barge at the door.

“The caused the rear locking mechanism to become dislodged. The accused also spat while within the rear of the police vehicle and continued to shout and swear at police and custody staff, threatening to murder them.

“Police required to take a specimen of breath. The accused was unruly throughout and refused to listen, singing over the police witnesses.”

Gordon Addison, defence solicitor, said: “This man’s life has deteriorated – he has lost his business and his relationship of 27 years. He has been drinking too much.”

The court heard the car Dunn was driving when he was arrested belonged to his 92-year-old grandmother.

Sheriff Derek Livingston banned Dunn from driving for two years, placed him on a supervised community payback order for two years and made him subject to a restriction of liberty order to remain in his 24 Pine Grove, Westquarter home between 7pm and 7am for the next six months.

Sheriff Livinston refused the Crown motion to seize the car belonging to Dunn’s gran.
