Text message sparks row

Police were called after James Fullarton attacked his long-term partner in her home.

During the row in the early hours of December 2 he seized the woman he had been in a relationship with for 13 years by the neck.

After Fullarton left the scene, the woman called her mum who then contacted the police.

At Falkirk Sheriff Court last Thursday Fullarton appeared from custody to be sentenced for assault. He had originally denied the charge, but now pleading guilty to one that had been “heavily amended”.

The court was told the argument had started after the woman read a text on his phone she suspected was from a woman he was having an affair with.

Fullarton’s lawyer claimed: “She started the violence by pushing him at the top of the stairs. She exaggerated what happened when she gave her statement to police, but she was certainly angry about the text.”

Sheriff John Mundy was told that Fullarton had been remanded in custody for five weeks after his arrest and been released on bail on January 13 with the added condition he have no contact with her before his trial.

He was appearing from custody because he breached bail by going to see her on March 15.

The Crown accepted his not guilty plea to that offence and Sheriff Mundy adjourned the case until April 18 for reports. But he warned Fullarton, who stays with his mum in Kilsyth but shares his time between the two homes, the bail conditions remain in place.
