Prison for Denny thug who threatened to infect police with Hep C and COVID-19

An offender who struggled with police – elbowing one in the face – then started spitting while in custody saying he had Hepatitis C and coronavirus.

Michael Heenan (44), 72A Herbertshire Street, Denny, appeared at Falkirk Sheriff Court on Thursday having admitted attacking a police officer – elbowing him to the head – behaving in a threatening manner and obstructing police officers in their duty in Kilbirnie Terrace, Denny on April 7, 2020.

Last month Heenan failed to attend court because he supposedly had COVID-19.

On Thursday, procurator fiscal depute James Moncrieff said: “It was 3.30pm and police received a call a man with a minor head injury was wandering around in the street. The accused was seen – he was heavily intoxicated and elbowed a police officer to his face, although no injury was sustained.

"In the rear of the police vehicle he started shouting, swearing and spitting ‘I’ve got Hep C and anyone who open this door I’m going to spit on’ and ‘I’ve got COVID-19 – I’m going to spit in your faces’.”

It was stated it had been six months since Heenan committed an offence.

Sheriff Christopher Shead said: “He has breached his orders so much even the social work department don’t seem willing to accommodate him. They say he dosen’t appear to be motivated to stop his alcohol abuse.

"Although he has been attending CADs voluntarily it hasn’t had an impact on his conduct. This is one of the worst reports the court has seen in recent times – you are not interested in complying with alternatives to custody.”

Sheriff Shead sentenced Heenan to five months in prison.
