Grangemouth drink driver spat in cop's face

A drink driver committed her first offence at the age of 48 and then committed her next one a matter of minutes later by assaulting a police officer.

Aleksandra Rak (48) was spotted in charge of a damaged car and found to be over three times the legal drink driving limit when police arrested her. When she arrived at the police station to be processed she proceeded to spit in an officer’s face.

Rak, 51a Strowan Road, Grangemouth appeared at Falkirk Sheriff Court last Thursday having pled guilty to drink driving in Kersiebank Avenue, Grangemouth on January 2. She gave a reading of 75 microgrammes of alcohol in 100 millilitres of breath when the legal limit is 22 microgrammes.

She also admitted assaulting a female police officer at Falkirk Police Station on the same day and failing to give police details.

The court heard police received a call from a member of the public about a car vehicle in Grangemouth which had sustained damage to the front of the vehicle. People had seen the accused switching the car engine off and then going into a house.

When police arrived Rak was in her bed. She was arrested and taken to Falkirk Police Station and assaulted a female officer by spitting in her face.

Rak, who is Polish and required an interpreter in court, had been drinking alcohol to cope with trauma in her life at the time of the offence.

She was said to be ashamed of herself for drink driving and with the way she subsequently handled herself at the police station.

The court heard Rak was unlikely to re-offend.

Sheriff James MacDonald said Rak had to understand the spitting offence was a different level of offending to the road traffic matters and he had been considering a custodial sentence.

He added: “Offences of this type against police officers in the execution of their lawful duty will not be tolerated. I have, without hesitation, sent people to prison for this type of offence.

“You’re 48 and this is your first offence – that in itself is a tragedy. I take into account there were issues in your personal life.”

He banned Rak from driving for 12 months and fined her £900 to be paid back at a rate of £50 per month.
