Falkirk offender sent woman pictures of himself holding a gun

A man sent a picture of himself holding a gun to a woman and failed to see how this would have frightened her.

Alexander Burt (55) was said not to realise the serious implications of the photograph he sent or how it would have make the recipient feel frightened.

He also did not want to pay a monetary penalty because he stated the victim “doesn’t need the money”.

Appearing at Falkirk Sheriff Court last Thursday, Burt had already admitted sending the threatening photograph to the woman from his 7 Thornbridge Road, Falkirk home on April 16.

Referring to Burt’s social work report, Sheriff Derek Hamilton said: “I don’t think you understand the seriousness of this matter and the trouble you are in here. You are of the view the offence does not merit a custodial sentence – you and I have differing views on this matter if that’s your opinion.

“You also don’t think a monetary penalty is appropriate because the complainer doesn’t need the money. It’s not a great report Mr Burt. It’s an indication of your attitude to this offence and to the victim.

“You seem tobe of the view it’s something quite minor – it’s far from that. Although you have very little record you are on the cusp of custody here and appreciate that.”

Sheriff Hamilton placed Burt on a supervised community payback order for two years with the condition he complete 130 hours unpaid work in that time and he attend for alcohol support counselling.
