Falkirk head butt attack caught on CCTV

The attack was captured on CCTV and Gray, 54 Castle Street, Clackmannan, was charged with the assault.

Procurator fiscal depute Katie Cunningham said: “A CCTV operator was concerned by the behaviour of the couple towards one another. The woman hit the accused which led to a struggle between them.

“The accused then hit her to the head before walking away from her. He returned and head butted her causing her to move back against a wall. She did have swelling to her right cheek which didn’t require medical attention.”

The court heard the woman had also been charged with assaulting Gray.

Murray Aitken, defence solicitor, said: “Alcohol had been consumed by both parties. She has three young children from a previous relationship and she and the accused didn’t get to go out much.

“This was the first time they had gone out for a long time and they had employed a baby sitter. She punched him and he accepts he reacted in the manner described. They are no longer together.”

Sheriff Derek Livingston said: “I accept there was some element of provocation, but you went back and head butted the complainer and that’s completely unacceptable.”

He placed Gray, 54 Castle Street, Clackmannan, on a two-year supervised community payback order and told him to complete 150 hours unpaid work in six months.
