Falkirk drug offender does no work and gets even more toil for his trouble

An offender’s lack of commitment to his community payback order saw him receive even more hours of unpaid work which he must do or face prison.

Scott Mawhinnie (49) appeared at Falkirk Sheriff Court on Thursday having pleaded guilty to possession of class B drug cannabis in Ochil Street, Grangemouth on May 16, 2019.

It was stated Mawhinne had breached the community payback order he received as punishment for the offence and had spent time remanded in custody.

Stephen Biggam, defence solicitor, said: “His time on remand had forced him to face his underlying difficulties.”

The court heard Mawhinne had been given 240 hours unpaid work to complete but had only done three-and-a-half hours.

Sheriff Simon Collins QC said: “You have been given a further opportunity to do these hours and you have made no effort to do so – this is not optional.”

Sheriff Collins varied the hours, meaning Mawhinne, 66 Thornbridge Road, Falkirk, must now compete 265 hours unpaid work within 12 months.
