Bo'ness drunk flashed in front of partner and friends and refused to leave home

A drunk man flashed in front of his partner and friends before angrily telling the woman she’d have to call police if she wanted to kick him out.

Sam Pate (26), Redbrae Avenue, Bo’ness, appeared at Falkirk Sheriff Court on Thursday having pleaded guilty to shouting, swearing and uttering threats at an address in Oronsay Avenue, Maddiston on January 2.

He’d also admitted failing to comply with a court order which banned him from contacting the woman by repeatedly sending texts to her on January 20.

Pate and the woman lived together and had been in a “volatile” relationship for around three years at the time of the incident, the court was told.

The woman had invited friends over for dinner and drinks on January 1. Pate was also there and had been drinking with the guests.

Procurator fiscal depute Ann Orr said: “In the early hours of January 2, the complainer went to bed.

“Her friend also stayed over and the accused and the other friend stayed downstairs drinking.

“At about 4am the complainer woke up and could hear the accused and the others downstairs. It seems there was laughing and joking.

“He was clearly under the influence. He was flashing, exposing his penis.

“She challenged him and asked him to leave – he wouldn’t and that then escalated into shouting and a disturbance, with the accused refusing to leave.

“His partner left him to calm down and walked her friend to her own home.

“The accused had gone to sleep and woke up to find the complainer had packed his bags and that resulted in a further argument, with the accused saying she’d need to get police to remove him.

“Police were contacted and responded urgently. The complainer was shaken and fearful.

“He was arrested, taken to the police office and made no reply.”

His defence solicitor described Pate as having “a difficulty with thinking of the consequences of his actions”.

The court heard Pate now stays with his mum and dad and the woman indicated to police she didn’t wish to have further contact with him.

Pate was placed under supervision for 18 months. He was also made subject to a two-year non-harassment order and a four-month, 6pm-6am restriction of liberty order.
