ASBO girl broke order with Tuesday morning party

Kirsty McFarlane (25) refused to turn down the music and keep a lid on the noise, despite complaints from residents who were trying to get to sleep for their work later that day.

She had managed to stay clear of trouble for a number of years before this incident.

Appearing at Falkirk Sheriff Court last Thursday, McFarlane, 20 Wallace Crescent, Denny, pled guilty to causing her neighbours alarm on Tuesday, May 3 and breaching the anti-social behaviour order that had been put in place on June 6, 2012.

Mhairi Alexander, procurator fiscal depute, said: “The witnesses live underneath the accused and could not get to sleep due to the constant singing, banging and general disturbance.”

Defence solicitor Simon Hutchison said: “She didn’t think the noise was unusually loud for her.”

Sheriff John Mundy pointed out it was loud enough to keep her neighbours from getting to sleep and some of them had to be up for work as early as 5am.

Mr Hutchison said: “She managed to stay out of trouble for three years before this matter.”

McFarlane had 32 hours of unpaid work on her community payback order remaining.

Sheriff Mundy added on another 80 hours of work to the existing order and told McFarlane to complete it within six months.
