April injection assault trial

Andrew McKay (32) is said to have injured the alleged victim by jabbing her with a syringe containing the diabetes-control hormone.

The charges stated the attack reportedly took place at an address in Shieldhill, Falkirk, on April 12, 2014.

It is alleged the incident was either an assault by McKay, or alternatively an act of culpable recklessness.

McKay of Nisbet Drive, Denny, also faces a second charge alleging that on the same date and at the same address, he assaulted and injured his female victim to the danger of her life by repeatedly pushing her, repeatedly seizing hold of her hair and pulling her by the hair, and repeatedly punching her on the head.

The trial was due to take place this week, but appearing at Falkirk Sheriff Court on Tuesday, McKay was informed by Sheriff John Mundy there was “insufficient time” left in the current jury sitting for his case to proceed at this stage.

Sheriff Mundy said: “It’s very regrettable, but we will have to adjourn the trial.”

The sheriff ordered McKay, who denies all charges against him, to appear in court at a pre-trial hearing on Tuesday, March 29.

The trial itself, which will take place in front of a jury, is scheduled to begin on Monday, April 11.

Procurator fiscal depute Jemma Eadie said proceedings were expected to last at least “two or three days”.
