Robert Swan shouted racist abuse before lashing out in what was described as a racially motivated attack.

The 37-year-old threatened Phethezakhe Mlilo in Cumbrae Drive, Tamfourhill, on August 1 before punching him on the head.

At Falkirk Sheriff Court last Thursday Swan, who has been in prison before, narrowly avoided being sent to jail again for his shock behaviour.

Swan, from 52 Sir William Wallace Court, Larbert, had admitted behaving in a threatening or abusive manner, uttering racist abuse and assault at a previous appearance and had sentence deferred for social workers to complete background reports.

Sheriff Craig Caldwell said Swan’s conduct was “unacceptable” - and warned him: “Given your history you are very much at risk of a further period of custody.

“Offend in this way in future and you will go back to jail.”

He fined Swan £400 to be paid at £30 a week.
